Terms of Service

Effective August 5, 2026

Athlon provides personal finance tools for athletes. These Terms of Service ("Terms") govern your use of Athlon's website, mobile applications, and related products and services (collectively, the "Services").

By accessing or using the Services, creating an account, connecting an account, joining the waitlist, or otherwise using Athlon, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Who We Are

Athlon, LLC ("Athlon," "we," "us," or "our") provides software and tools designed to help athletes and, where applicable, their families manage spending, payments, financial organization, and related tax and budgeting workflows.

Athlon is not a bank, not a law firm, not an accounting firm, not a tax advisor, not an investment adviser, and not a broker-dealer, unless we expressly state otherwise in a separate written agreement.

Some features are provided or supported by third-party partners, including banks, card issuers, processors, account connectivity providers, KYC and fraud vendors, and other regulated service providers. Those features may be subject to additional terms, disclosures, and partner agreements.

2. Eligibility

You may use the Services only if you can legally enter into a binding agreement and your use of the Services is permitted by applicable law.

You must be at least 18 years old to open and use an Athlon account. Minor accounts are not currently offered.

If and when Athlon permits accounts for users between 13 and 17 years old, those accounts will require a parent or legal guardian to provide any required consent and to accept responsibility for the account, as set out in our Teen Account Parent / Guardian Consent Addendum. We will update these Terms before offering minor accounts.

You may not use the Services if:

  • you provide false, incomplete, or misleading information;
  • you are using the Services without authority;
  • your use violates applicable law;
  • or your account presents fraud, compliance, safety, or operational risk.

3. Your Account

You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for safeguarding your login credentials, devices, and account access. Notify us immediately at support@athlon.finance if you suspect unauthorized access, fraud, or a security issue.

We may request additional information or documentation at any time to verify your identity, age, authority, linked account ownership, guardian relationship, or eligibility to use certain features.

4. Electronic Communications

You agree to receive disclosures, notices, statements, alerts, and other communications electronically, including by email, in-app message, push notification, or other electronic means.

You are responsible for keeping your contact information current and for reviewing communications we send you.

If you withdraw consent to receive required electronic communications, some Services may no longer be available to you.

5. SMS and Phone Communications

If you provide your phone number or opt in to texts, you agree that Athlon and its service providers may send you transactional, authentication, security, operational, and, where permitted, promotional messages.

Message and data rates may apply. Message frequency may vary. You can opt out of marketing texts by following the instructions in the message, such as replying STOP where available. Opting out of certain non-marketing messages may affect features like login verification or fraud alerts.

6. Connected Accounts

You may be able to connect bank accounts, cards, or other financial data sources through Athlon, including through providers like Plaid.

By connecting an account or source, you authorize Athlon and its providers to access, retrieve, receive, and use information from that source, including balances, transactions, liabilities, and related data, as needed to operate the Services.

You represent that you have the authority to connect any account or source you link.

If you disconnect a source, we may stop receiving new data from it, but we may retain previously received data as described in our Privacy Policy and as required by law.

7. Payments, Transfers, and ACH

Not currently offered. Athlon does not currently offer payment, payout, transfer, refund, or account funding features. This section takes effect only if and when such a feature is offered and you enroll in it.

If you use payment, payout, transfer, refund, or account funding features, you authorize Athlon and its applicable partners to process those transactions in accordance with your instructions, applicable program terms, and applicable law.

Where ACH is used, transactions may be governed by applicable ACH network rules, including NACHA rules. You agree to maintain sufficient funds for authorized debits and to promptly resolve returned or failed transactions.

8. Cards and Spending Controls

Not currently offered. Athlon does not currently offer a card, and has no issuing bank or card program partner at this time. This section takes effect only if and when a card is offered and you receive or use one.

If you receive or use a card through Athlon, your card may be issued by a third-party bank or financial partner and may be subject to separate cardholder terms and disclosures.

Athlon may offer spending controls, rules, or alerts based on category, merchant type, time, amount, or other criteria. These controls may rely on third-party data, such as merchant category codes, and may not always work perfectly. You remain responsible for your transactions except where consumer protections apply by law.

9. Financial Tools; No Professional Advice

Athlon may provide dashboards, summaries, budgeting tools, transaction categorization, tax-related organization tools, AI-generated insights, reminders, and other informational features.

These features include Safe-to-Spend estimates, projections, transaction classifications, budgeting information, and contextual financial insights. They are generated from information available to Athlon at the time and may be delayed, incomplete, or inaccurate.

Safe-to-Spend and similar figures are informational estimates. They are not available balances, account balances, guarantees, instructions to spend, or professional advice.

These features are for general informational, organizational, and product-use purposes only. Unless we expressly agree otherwise in writing, Athlon does not provide legal, tax, accounting, investment, credit, or fiduciary advice.

You remain responsible for your own financial decisions, spending, filings, elections, recordkeeping, and compliance.

10. AI and Automated Features

Athlon offers optional Financial AI features that let you ask questions about your financial information and receive written responses, summaries, and suggestions.

Financial AI features are optional. External processing by a third-party AI service provider occurs only when you use an AI feature after providing the required consent.

You may withdraw your consent to AI processing at any time. Withdrawal applies to future processing and does not require you to close your Athlon account. Non-AI features may remain available to you after you decline or withdraw consent.

Saving your AI conversation history requires a separate consent from the consent to external processing.

Athlon selects and controls the active AI service provider for all users; you do not select the provider. Athlon plans to launch Financial AI using OpenAI as its planned initial provider. Athlon may replace OpenAI with another reviewed provider, such as Google Gemini or Anthropic, based on privacy, security, quality, availability, or business considerations, following its security, privacy, and legal review. A provider change should not materially alter the app experience. The AI & Data Processing Notice identifies the current active provider and is updated when the provider changes, and Athlon will provide additional notice or seek renewed consent where a material processing change legally requires it. Training, retention, privacy, and security statements depend on the active provider's approved contract and configuration.

AI outputs may be incomplete, stale, delayed, unavailable, or inaccurate and require your independent review before you rely on them. Financial AI is informational and is not legal, tax, accounting, investment, credit, or fiduciary advice.

Financial AI does not automatically move money, transfer funds, make payments, modify or close accounts, submit filings, or execute other consequential financial actions. Confirmations and consequential proposals surfaced by Financial AI are review-only.

Athlon also uses rules and models to organize information, detect anomalies, and support fraud, risk, and security review.

Additional details are available in our Privacy Policy and our AI & Data Processing Notice.

Where required by law, you may request human review of certain decisions by contacting support@athlon.finance.

11. Prohibited Activities

You may not use the Services to:

  • violate any law, regulation, or court order;
  • commit fraud, impersonation, identity theft, or deceptive activity;
  • engage in money laundering, sanctions violations, or other prohibited financial conduct;
  • bypass onboarding, verification, limits, or controls;
  • access another person's account without authorization;
  • exploit, misuse, or interfere with minor or guardian account relationships;
  • reverse engineer, scrape, data mine, or probe the Services without authorization;
  • upload malware, malicious code, or harmful automated scripts;
  • interfere with the security, integrity, or availability of the Services;
  • infringe another person's rights;
  • or otherwise misuse the Services or any partner-provided feature.

We may investigate suspected violations and may suspend, restrict, or terminate access where appropriate.

12. Fees

Some Services may be free, and some may require payment, subscription, or separate enrollment. If a fee applies, we will disclose it at or before the time you enroll or are charged.

Unless otherwise stated, fees are in U.S. dollars and are non-refundable except as required by law or expressly stated otherwise.

If you enroll in a recurring paid feature, you authorize Athlon or its payment processor to charge your payment method for applicable fees and taxes until canceled.

We may change fees from time to time and will provide notice where required.

13. Third-Party Services

The Services may include or depend on third-party products and services. Your use of those services may be subject to separate third-party terms and privacy policies.

Athlon is not responsible for third-party products, services, websites, policies, data practices, outages, acts, omissions, or decisions, even if they are integrated with the Services.

14. Privacy

Your use of the Services is subject to our Privacy Policy.

15. Intellectual Property

Athlon and its licensors own the Services, including our software, design, text, graphics, content, trademarks, and logos.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for their intended purpose.

You may not copy, modify, distribute, reverse engineer, or otherwise exploit the Services except as permitted by law or with our written permission.

16. Feedback

If you send us suggestions, ideas, feedback, or other comments about Athlon, you grant us the right to use them for any purpose without compensation or attribution to you.

17. Suspension and Termination

You may stop using the Services at any time.

We may deny, restrict, suspend, freeze, or terminate your access to some or all of the Services if:

  • you violate these Terms;
  • your information cannot be verified;
  • we suspect fraud, abuse, misuse, or illegal conduct;
  • a partner requires us to do so;
  • we are addressing a dispute, security issue, or compliance concern;
  • or continued access presents legal, safety, reputational, or operational risk.

We may retain records as required by law, partner obligations, or legitimate business needs.

18. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied.

We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times, or that any output, insight, or financial result will be accurate or achieved.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

19. Limitation of Liability

To the fullest extent permitted by law, Athlon and its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business interruption arising out of or related to the Services or these Terms.

To the fullest extent permitted by law, Athlon's total liability for any claim arising out of or related to the Services or these Terms will not exceed the greater of:

  • the amount you paid to Athlon in the 12 months before the event giving rise to the claim; or
  • $100.

Nothing in these Terms limits liability that cannot be limited under applicable law.

20. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Athlon and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • your misuse of the Services;
  • your violation of these Terms;
  • your violation of law or third-party rights;
  • or information or content you submit through the Services.

21. Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

Except where prohibited by law or where a claim may be brought in small claims court, you and Athlon agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, not in court.

You and Athlon each waive the right to a jury trial and the right to participate in a class action, class arbitration, representative action, or private attorney general action, except to the extent that waiver is prohibited by law.

Arbitration will be administered by the American Arbitration Association (AAA) under its applicable consumer arbitration rules. The arbitration will take place in Miami, Florida, unless applicable law requires otherwise.

You may opt out of this arbitration provision by emailing legal@athlon.finance within 30 days after you first accept these Terms. Your email must include your full name, the email address associated with your account, and a clear statement that you want to opt out of arbitration.

If any part of this section is found unenforceable, the remainder will remain in effect to the fullest extent permitted by law.

22. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles, except to the extent federal law or the law governing a partner-provided feature applies instead.

23. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date and provide notice as appropriate, including by posting the updated Terms, notifying you in the app, or emailing you.

Your continued use of the Services after the updated Terms take effect means you accept the revised Terms.

24. Miscellaneous

These Terms, together with any incorporated policies, disclosures, and feature-specific terms, are the entire agreement between you and Athlon regarding the Services unless a separate written agreement applies.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect.

Our failure to enforce any provision is not a waiver of our right to do so later.

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
