Electronic Communications Consent

Effective May 1, 2026

This Electronic Communications Consent ("E-SIGN Consent") applies to Athlon, LLC ("Athlon," "we," "us," or "our") and governs how we provide records, disclosures, notices, agreements, statements, tax documents, card and account materials, authorizations, and other communications relating to our website, apps, products, and services (collectively, the "Services") in electronic form.

This E-SIGN Consent applies to the categories of records listed below during your relationship with Athlon, including while you are joining a waitlist, applying for, enrolling in, using, maintaining, or closing a Service, and after closure to the extent electronic records may still be provided as permitted by law.

By checking the applicable consent box, clicking to accept, creating an account, or otherwise agreeing where presented, you consent to receive electronic records and communications from Athlon and, where applicable, from our financial partners and service providers, to the extent permitted by law.

Your consent applies to records and communications relating to:

your Athlon account;
your use of the Services;
waitlist, onboarding, verification, and support communications;
account-linked features;
payment, transfer, funding, refund, debit, or payout features;
card, bank, prepaid, wallet, or related partner-provided features;
tax, reporting, statements, and other account-related records;
disclosures, agreements, amendments, notices, privacy notices, and change-in-terms notices;
and any other records that law permits us to provide electronically.

B. Methods of electronic delivery

We may provide electronic records by:

email;
in-app or website display;
PDF or other downloadable files;
posting in your account or dashboard;
text message with a link where appropriate;
push notification or other electronic means.

C. Paper copies

You may request a paper copy of an electronic record by emailing support@athlon.finance or legal@athlon.finance. We may charge a reasonable fee only if permitted by law and disclosed to you at the time of your request. If no fee is stated, no fee will be charged.

You may withdraw this E-SIGN Consent at any time by emailing support@athlon.finance or legal@athlon.finance.

Withdrawal of consent will not affect the validity of electronic records previously provided.

If you withdraw consent, some or all Services may no longer be available to you, especially where electronic delivery is required to open, maintain, or use a feature. If this happens, we may close, limit, or transition your access as permitted by law and any applicable partner terms.

E. Updating your contact information

You must keep your email address, phone number, mailing address, and other contact information current so we can send you required records and notices.

You can update your information through the Services where available or by contacting support@athlon.finance.

F. Hardware and software requirements

To access and retain electronic records, you must have:

a device with internet access;
a current version of a supported web browser or the current version of the Athlon mobile app;
an active email account;
the ability to view PDFs or other common electronic file formats;
and either a printer or sufficient electronic storage to save copies of records.

If these requirements change in a way that creates a material risk that you may no longer be able to access or retain electronic records, we will provide notice as required by law.

By agreeing to this E-SIGN Consent electronically where presented, you confirm and demonstrate that:

you can access this consent in electronic form;
you have the hardware and software needed to access and retain electronic records;
your electronic signature and assent have the same legal effect as a handwritten signature;
and you consent to receive covered records electronically.

H. Additional partner disclosures

Some partner-provided financial features may require separate electronic consent, account disclosures, cardholder agreements, privacy notices, or other records. Your use of those features may require you to separately review and accept those records.
